Terms of Service
Effective date: 1 November 2026. NextWhistle (formerly Kickoff). Last updated: 2 November 2026. NextWhistle, a Tinker and Scribe company. These terms are a contract between your organization and Tinker and Scribe Workshop Inc., 1146 Route 895, Elgin, NB E4Z 2M3, Canada. Questions: chris@nextwhistle.ca.
The service
NextWhistle is software. Clubs, schools, boards and associations use it to run a season: accounts, registration, rosters, the schedule, attendance, fields and a facility calendar. Tinker and Scribe Workshop Inc. provides the software. NextWhistle is not a sports club, not a bank, and not the merchant for parent registration fees.
Accounts
Account holders are adults 19 or older (the age of majority in New Brunswick). Players are roster records entered by a club or a parent. They do not get accounts, except where a club turns on optional youth player logins. You are responsible for your email and password and for what people you invite do with the access you give them. An organization admin decides who is a coach, a parent or another admin. We may suspend an account that breaks these terms.
Club responsibilities for member data
The club is the controller of its members' information. When a club admin uploads or imports member data (including by CSV), the club confirms it has authority — permission from those families — to upload their contact and player records, and that it collected them lawfully. Imports do not create photo consent or accept a risk acknowledgement for anyone. Do not upload Social Insurance Numbers, health card numbers or police check documents.
Starter risk acknowledgement and code-of-conduct text is a sample only, not legal advice and not a legal release. Each club is responsible for its own participation terms and insurance, and should have them reviewed by its own lawyer or sport association.
Parent registration money
Clubs bring their own Stripe account through Stripe Connect. Parent registration fees go to the club's connected account. NextWhistle never holds parent registration money and takes no application fee. The club is the merchant for those fees and handles their refunds.
Pricing
All prices are in Canadian dollars, plus applicable taxes.
Clubs and leagues: CA$1.50 per unique registered player per billing year · CA$149 minimum per billing year (up to 99 players) · CA$1,500 maximum per billing year, for all seasons combined (1,000 or more players) · plus applicable taxes. The minimum always appears on the same line as the rate.
Billing year: a club's billing year is the 12 months starting on the date of its first billed season, and each 12 months after that. "Year" in this section and in §6 means the billing year.
Who counts: each unique registered player is counted once per billing year at a club, across all sports and seasons, including concurrent seasons. A player already counted that billing year is not counted again for another sport or season. Coaches, referees, volunteers and managers, and waitlisted, withdrawn or cancelled-and-refunded registrations, are not counted.
Schools: CA$4 per athlete per school year · CA$449 minimum (up to 112 unique athletes) · plus applicable taxes · billed annually by invoice or PAD.
School boards: CA$3 per athlete, with a board minimum of CA$1,200, plus applicable taxes. Board pricing is quoted on request and is subject to the board's procurement rules.
Retired introductory code: the previous introductory season code is retired and is not honoured. Entering it, alone or with another code, does not change the price.
Optional setup: CA$249 plus applicable taxes, done by email, no meetings.
Billing
When clubs are billed. We bill the club at the earliest of these dates: when registration closes, 14 days after the season starts, or 60 days after the season is created in NextWhistle. The bill covers the players registered on that date. If you pay by pre-authorized debit, we will send you written notice of the amount and debit date at least 10 days before the debit, and we will debit only the amount in that notice. We send the debit notice on the billing date. The debit is made 10 days after the notice. A true-up for players added later gets its own notice, and its debit is made 10 days after that notice. If we are late sending a notice for any reason, we will not debit until at least 10 days after the notice is actually sent. We will also send a reminder 6 days before the debit. Players who register after the notice is sent are billed later under the true-up rule in section 6, with their own notice at least 10 days before that debit. If you pay by card checkout, we will email you a payment link on the billing date. A season starts on the season start date set for it in the app. At trial start, the club signs a PAD mandate (Canadian pre-authorized debit) and nothing is charged (CA$0). Nothing, including the CA$149 minimum, is charged upfront; billing happens later under the rules in this section. A season with zero registered players is not billed, and the CA$149 minimum does not apply to it. The CA$149 minimum is a yearly floor, charged on the first billed season. Later seasons that billing year are charged only for the amount by which the year's total (CA$1.50 × unique players) exceeds what the club has already paid. The CA$1,500 maximum covers all seasons in the billing year combined.
Notice before billing. We email the club admin the invoice — player count, rate, minimum or cap, discount and applicable taxes — at least 10 days before we charge it, so the club can check the count, and we send a reminder 6 days before the charge.
Season-end true-up. The first 5 players added after billing are not charged. From the 6th added player onward, we bill a true-up for the difference between the season price for the new number of players and what we already billed for that season. The season minimum and the yearly cap still apply. A player already counted at the club that billing year is not counted again, and the billing year's total never goes above the CA$1,500 maximum.
Schools are billed annually.
Unpaid invoices. If an invoice is still unpaid 30 days after its due date, we email the club admin a reminder, and then another reminder every 10 days. If it is still unpaid 60 days after its due date, the club's account is suspended for non-payment. While a club is suspended for non-payment: - club admins can still sign in to pay the invoice, and to view and export the club's data ; - the club's public pages and registration stop, and no new charges are made ; - nothing is deleted because of the suspension ; - once the invoice is paid, the account is restored automatically as soon as payment clears.
Pre-authorized debit (PAD)
If you pay by PAD, you authorize Tinker and Scribe Workshop Inc. (through Stripe) to debit your organization's bank account for NextWhistle invoices, as a business PAD. Amounts vary with your player count. We will send written notice of the amount and date at least 10 days before each variable-amount debit, and a reminder 6 days before the debit. We debit only the amount in that notice, on the date and timing set out in §6 (10 days after the debit notice for that bill). If we are late sending a notice for any reason, we will not debit until at least 10 days after the notice is actually sent. You may cancel your PAD authorization at any time on 30 days' written notice sent to chris@nextwhistle.ca. Cancelling this authorization does not cancel your NextWhistle subscription or any amount already owed. You have certain recourse rights if any debit does not comply with this agreement. For example, you have the right to receive reimbursement for any debit that is not authorized or is not consistent with this PAD Agreement. To obtain a sample cancellation form, or more information on your right to cancel a PAD agreement or on your recourse rights, contact your financial institution or visit www.payments.ca.
Free trial
Every club or league can try NextWhistle free for 30 days, with no card and no charge (the club signs a CA$0 PAD mandate at trial start; see §6), all features, and no limits on teams or players. The trial starts when you sign in with the verified email address you used to request it. One trial per club, league and email address. We email the club admin 7 days and 2 days before it ends. When it ends, we don't charge you; the club pauses (view-only, with the Facility Calendar still working). Opening live registration does not end the trial; the trial runs its full length. We may refuse, shorten or end a trial, by email, if we see misuse. Paused-club data handling is in the privacy policy.
Refunds and cancellation
Season fees are not refunded once billed, except for billing errors and duplicate charges reported to chris@nextwhistle.ca within 60 days of the charge, and where New Brunswick law requires a refund. Closing an account does not by itself refund a season fee. Parent registration fees are refunded by the club, on the club's own Stripe account. NextWhistle never holds that money.
Free Facility Calendar
Free with no time limit: 2 sites and 5 pads each, conflict-aware booking. Municipal Facility Manager: CA$1,200 per year.
Acceptable use
Do not use NextWhistle to break the law or collect information you have no right to hold; harass, threaten or abuse anyone, including in chat; upload malware or try to reach another club's data; send spam or pretend a message is from a league when it is not; or resell or scrape the software. Club email announcements must go only to the club's registered members and families, and must not be used for third-party advertising. Breaking these rules may lead us to suspend or end the account.
Your content
League content (rosters, messages, bookings) belongs to the organization that entered it. You give Tinker and Scribe Workshop Inc. permission to host and display it so the service can run. You can export your club's archive at any time.
Club admins
If you upload a payment report or other file containing information about people, you confirm that you have the right to share it with us for that purpose, including any permission required from the school or organization that issued it. You're responsible for that permission. We use uploaded files only to match payments to registrations. Rows that don't match a registration are kept as pending players, with only the name, a protected code made from the student number (not the number itself), the last 3 digits of the student number, the amount and the payment reference. Club admins can see them. If an admin assigns a pending player to a team, that team's coach can see the name, payment status, amount, reference and the last 3 digits, and can keep or discard the player. We delete pending players after 90 days unless a parent or guardian registers the player. We don't keep the file itself. After deletion, copies may remain in encrypted database backups, kept by us and by our database provider, for up to 30 days before they are overwritten. We don't use or restore them except to recover from a system failure. A school or organization that believes a file was uploaded without its permission can email us at chris@nextwhistle.ca, and we'll delete any data from it.
Data and privacy
How NextWhistle handles personal information is in the privacy policy (/privacy). The organization is the controller for registration and parent payments. NextWhistle is the processor. NextWhistle is not the merchant. We never use the information your club stores in NextWhistle to market NextWhistle or any other product.
Liability
NextWhistle is provided as available software for volunteer and community programs. Schedules, bookings and attendance lists can be wrong if someone enters them wrong or the service is down. To the extent New Brunswick law allows, Tinker and Scribe Workshop Inc. is not liable for indirect or consequential loss. If we are liable, the limit is the amount the organization paid us for NextWhistle in the 3 months before the claim. This limit does not apply where the law does not allow it, including injury caused by negligence, and it does not override the Consumer Product Warranty and Liability Act where that Act applies.
Termination
You can stop using NextWhistle at any time. Account deletion paths are in the privacy policy. We can suspend or end access if these terms are broken, if an invoice is unpaid, or if we discontinue the service; if we discontinue it, we will email you and give a reasonable window to export your data. Ending access does not cancel an invoice already earned.
Changes to these terms
We will email club admins about material changes, including price changes, 60 days before they take effect. This 1 November 2026 pricing change is effective on 1 November 2026, with no advance notice.
Name change (pre-launch): NextWhistle was renamed from Kickoff before launch. The operator, Tinker and Scribe Workshop Inc., is unchanged.
Governing law
The English and French versions of these terms are equally authoritative. These terms are governed by the laws of New Brunswick and the federal laws of Canada that apply there. Disputes are heard in the courts of New Brunswick.
